In 2023, the H-1B visa program has seen some significant changes, including a proposal from the government to increase fees. The increased fees are aimed at generating additional funds for the U.S. Citizenship and Immigration Services (USCIS). Among the proposed fee increases, USCIS plans to hike the registration fee for the H-1B Cap Lottery from $10 to $215 per registration, and the government filing fee for H-1B applications from $460 to $780.

Another important change is the U.S. State Department’s plan to start a pilot program this summer to reintroduce domestic visa renewals for H-1B visa holders. The domestic visa renewals aim to streamline the application process and reduce processing times, removing the requirement of H-1B holders to travel to a U.S. consulate abroad to renew their visa.

H-1B Visa Trends

Under the Biden administration, there have been positive developments in the H-1B visa program. Some of the noticeable trends include shorter processing times for H-1B applications.  Unfortunately for businesses and prospective H-1B visa applicants, the demand for the H-1B visa has increased significantly in the last two years.  This makes it more difficult for businesses and individuals to secure an H-1B visa.

The FY 2024 H-1B Lottery took place in March.  The annual H-1B visa lottery plays a significant role in the application process for first-time petitions. The government issues a total of 85,000 visas each year, with 20,000 reserved for individuals holding a master’s degree or higher, and 65,000 for other qualified applicants.  Last year, over 483,000 registrations were submitted by over 48,000 employers.

Understanding the H-1B Visa Lottery and Registration Timeline

To participate in the lottery, employers must register their employee or candidate in the H-1B electronic registration system and pay a $10 fee. The H-1B registration timeline for FY 2024 was as follows:

March 1: H-1B registration period opens.
March 20: H-1B registration closes.
March 31: USCIS informs selected registrants.
April 1: Employers can begin submitting H-1B applications for selected registrants.
October 1: H-1B applicants that receive an approval may begin work on their new visa.
