What Is The P-1, P-2, and P-3 Visa?

Searching for an Employment-Based Visa? Call Our Immigration Firm for Assistance!

What Is The P-1, P-2, and P-3 Visa? Are you looking for a short-term work visa to reside in the U.S.? A P visa is one of many options available to athletes or those with a profession in entertainment taking their talents on the road. As long as you have a job offer from a U.S. employer and meet each qualification, you’ll be provided with a designated nonimmigrant P visa. And unlike other work visas, there is no annual cap on recipients.

What Are the Advantages or Disadvantages of Having a P Visa?

Part of the immigration process is weighing the pros and cons of applying for a certain visa. That’s something we can help you with when you consult with an attorney from our law offices of immigration. We outline several key details below to provide you with a better understanding and to determine if you are eligible for a P nonimmigrant visa.

  • With this visa, holders can work in the U.S. under the authorization of a P visa sponsor. However, changing jobs requires you to apply for a new one.
  • P visas are permitted for a certain period. Typically, it reflects the time you need to complete an event, assignment, tour, or task.
  • Athletes can remain in the U.S. for up to five years with the opportunity for an extension.
  • P visa holders can travel to and from the U.S. – or remain in the country so long as the visa is valid and active.
  • Spouses and unmarried children (younger than 21) can receive P-4 visas, allowing them to travel with the main applicant. However, they will not be permitted to work.
  • It can take up to six months for P visa applicants to hear back about their applications; and an additional three weeks for the visa to process after approval.
  • The expiration date is flexible depending on your profession.
  • With the help from visa attorneys, you might even be able to begin the application process for a green card.

Who Qualifies for A P Non-immigrant Visa?

P-1 Visa
A P-1 visa is available to certain athletes or teams with a distinguished reputation, international recognition, and a high-performance rate. Sports players must have a contract with a big sports league, team, or for an international event.

Entertainment companies with the same level of acknowledgment can apply as well. Each performer must have been involved for at least a year to qualify. This requirement can be adjusted as needed depending on certain conditions, such as an illness or inability to travel.

Individual entertainers cannot apply alone, as it is only available to groups in which 75% of its members have actively performed for a couple of years. For approval, a sponsoring U.S. employer must request proof in the form of awards, nominations, or other international recognition.

P-2 Visa
Artists and entertainers are welcome to apply for a P-2 visa, whether it’s for an exchange program, as an individual, or group. A written agreement is required for the application to get approved. Usually, a labor union from the U.S. will be involved to manage the negotiation.

P-3 Visa
Individuals from culturally unique groups that plan on traveling to the U.S. are considered if they plan on:

  • Teaching
  • Coaching
  • Developing programs

The employer must apply on your behalf. Subsequently, support personnel should also request a consultation from labor organizations, a statement describing why they are vital for the job, with a copy of the written contract.

Whichever the reason, we will find the proper P visa suited for you and your loved ones! If you’re interested, you can consult with an immigration attorney to review your eligibility and begin the application process.
